The Richie Incognito bullying story of his teammate, Jonathan Martin, has taken on a life of its own. From a legal perspective, employers, the Miami Dolphins in this case, must put all of its potential insurers on notice. Most claims-made insurance policies, and even some occurrence policies, require that a policyholder provide prompt notice of claims made against them, as well as “circumstances” that could reasonably lead to a claim.
